Liability in sport & play
Sports are healthy and fun. It usually goes well, but in the heat of the game, very sometimes things go wrong. Think, for example, of a misguided kick during a football match. If you are injured while playing sports, you may wonder if you are entitled to compensation. This is only possible if someone is responsible and liable for the accident.
Different rules apply in sports than in normal liability law. Not every mistake made by a player leads to liability. After all, sports involve risks, which players have to accept. Therefore, a "raised liability threshold" applies to sports and game situations: this means that liability is less likely to be assumed.
Only if, for example, someone completely fails to abide by the rules of the game, or goes "way too far" in the game, can liability arise. Moreover, the "own fault" factor on the victim's side must be taken into account, e.g. if they themselves made a wrong move or did not follow the rules of the game.
